Procedure

There are two ways for the extension of invention patent: extension of Chinese invention patent application to Macau and extending granted Chinese invention patent to Macau, and is only subjected to formality examination without search or substantive examination. 

If the extension application is based on a Chinese invention patent application, the Macau application could be filed at any time before the grant of the Chinese patent by CNIPO and the relevant documents should be filed within 3 months after the grant of the Chinese patent.

If the extension application is based on a granted Chinese invention patent, it should be filed within 3 months after the grant of the Chinese patent.

        Protection Term & Renewal

Annuity starts payable from the 4th year and any succeeding year since the filing date of the Chinese patent till the end of 20-year protection.
