A Standard Patent (R) should be based on a patent granted by the Chinese Patent Office, the United Kingdom Patent Office or the European Patent Office designating the United Kingdom (collectively called “designated patent”) and is only subjected to formality examination without search or substantive examination.
Procedure
A Standard Patent (R) should be prosecuted through the following two-stage request procedure before grant:
· First Stage---Request to record, should be filed within 6 months from the publication of the designated patent application.
· Second Stage---Request for registration and grant, should be filed within 6 months from the date of grant of the designated patent.
Wherein, the maintenance fee is due to be paid before the expiry of 5th and any succeeding year from the deemed filing date first occurring after the publication date of the request to record if the second stage request is not filed by that time.
· Protection Term & Renewal
A Standard Patent (R) registration is valid for a maximum period of 20 years and must be renewed every year after the expiration of the third year subsequent to the grant of the Standard Patent.
Procedure
A Standard Patent (O) application can be filed directly or claiming priority in Hong Kong. It needs to go through formality examination and substantive examination before grant of patent rights. As for the entire examination process from application to grant, it is usually expected to take at least two to three years.
There is a Pilot scheme for the Standard Patent (O), that is, an applicant may submit a request for deferral of formality examination for a period up to 12 months from the filing or priority date. Upon the expiry of the deferred period, the Registrar will resume formality examination automatically. Deferral of formality examination essentially allows an applicant to establish an early filing date without having to immediately furnish any claim(s).
Protection Term & Renewal
A Standard Patent (O) is valid for a maximum period of 20 years from the filing date and must be renewed every year after the expiration of the third year subsequent to the grant of the Standard Patent.
Procedure
A Short-Term Patent application can be filed directly or claiming priority in Hong Kong. The applicant must submit a search report issued by the search authority to the Hong Kong Intellectual Property Department simultaneously. We can provide services to obtain search reports from the China National Intellectual Property Administration. As for the time from application to grant, it is usually expected to take six to 12 months.
A Short-Term Patent application is not subject to substantive examination, but only formality examination before grant of patent rights. However, the patent owner or any third party with reasonable grounds may file a substantive examination request in respect of the patent with the Intellectual Property Department after grant. After the substantive examination, if the patent or the patent after amendments as required complies with the relevant regulations, the Intellectual Property Department will issue a “Certificate of Substantive Examination” to the patent. If it does not meet the relevant regulations, the Intellectual Property Department will revoke the patent.
Protection Term & Renewal
A Short-Term Patent registration is valid for a maximum period of eight years and only needs to be renewed once before the expiration of the fourth year from the filing date.
Procedure
A Design application can be filed directly or claiming priority in Hong Kong and is only subjected to formality examination. As for the time from application to grant, it is usually expected to take three to six months.
Protection Term & Renewal
A Design registration is valid for a maximum period of 25 years, renewable for periods of five years.
